Your privacy and the confidentiality of your work are the foundation of our service. This policy explains how we (Powerclaim GmbH; “Powerclaim”) handle your data across two distinct environments: the Powerclaim Software Applications and the Powerclaim.io Website & User Accounts.

Privacy Policy for Powerclaim Software Applications

This section addresses the confidential data you process when using the Powerclaim tools (“Powerclaim Software Applications”), including Custom GPTs, Gemini Gems, and tools like the Claim Drafter.

A. Information We Process: Your Confidential Work Data

The invention descriptions, claims, and any other text you input (“Confidential Work Data”) are processed to perform the core function of the application.

B. No Permanent Data Storage

The Powerclaim Software Applications are stateless applications. We do not create user accounts within the Powerclaim Software Applications, nor do we save your drafts or session history.

C. Regional Data Processing

Our Application Runtime, which handles the application logic and prompt routing, runs on a Vercel Serverless Function deployed in Frankfurt, Germany (fra1). All Generative AI Processing (your user prompts and the AI’s output) utilizes the enterprise Vertex AI Gemini API, which is configured to communicate with the Google Cloud region in Frankfurt, Germany (europe-west3).

D. No AI Model Training

The Powerclaim Software Applications utilize Google’s Gemini models via the enterprise Vertex AI API. According to Google’s Cloud Data Processing Addendum, they do not use customer data submitted to the Vertex AI API to train their models. E. Static Asset Delivery

The user interface files (HTML, CSS, and React JavaScript bundle) are delivered to your browser via Vercel’s global Content Delivery Network (CDN), typically from the Point of Presence (PoP) closest to you. This delivery contains only the static application code and does not process, store, or transmit any Confidential Work Data.

F. User Responsibility and Disclaimer

You, the user, are solely responsible for the data you process. While we have architected the Powerclaim Software Applications for maximum security, you must ensure that using any third-party cloud service complies with your internal and client confidentiality policies. Powerclaim disclaims all liability for any breach of confidentiality resulting from the use of our third-party cloud or AI service providers.

Privacy Policy for the Powerclaim.io Website & User Accounts

This section applies to data collected and stored through the Powerclaim.io website for account and billing purposes.

A. Account & Profile Data

When you register for an account, we collect and store the necessary information to provide our services. This includes your name, email address, hashed password, and Powerclaim Credit balance. This data is stored securely on our website server, hosted by hosting.de in Aachen, Germany. We retain this information as long as you maintain an account with us.

B. Financial & Transaction Data

We use Stripe to process all payments. When you purchase credits, your payment information is handled directly by Stripe’s secure, PCI-compliant environment. Powerclaim GmbH never sees, handles, or stores your credit card information. We do store your billing address on our secure server for invoicing purposes, as required by law.

C. Website Usage Data (Cookies)

We use essential cookies to maintain the functionality of our website. For example, when you log in, we set cookies to save your login information. These are functional and not used for tracking. If you have an account and log in, we will set up several cookies to save your login information. Logging out removes these login cookies.

D. Who We Share Your Data With

We do not share your personal account data with third parties, except as necessary to provide our services (e.g., with our payment processor, Stripe) or if required by law. If you request a password reset, your IP address may be included in the reset email.

E. Your Data Rights (GDPR)

If you have an account on this site, you can request to receive an exported file of the personal data we hold about you. You can also request that we erase your personal account data. This right does not include any data we are legally obliged to keep for administrative, legal, or security purposes (e.g., billing records for tax purposes).
